ArcelorMittal wins cybersquatting case

Company took the cybersquatter to UN's WIPO

Global steel giant ArcelorMittal has won a cybersquatting case against a Mumbai-based firm that was using some websites, similar to the trademark of the NRI billionaire LN Mittal-led company.

A Mumbai-based firm, known as Taj Group of Companies, had registered five websites--arcelorcement.com, arcelorlabs.com, arcelorlaboratories.com, arcelorchemicals.net and arcelorchemicals.com.

To restrain this entity for using trademark, the Luxembourg-based steel major approached the UN's World Intellectual Property Organisation (WIPO) in Geneva this June.

ArcelorMittal contended that the disputed Internet sites were identical in part and confusingly similar as a whole to the 'Arcelor' trademark, for which it owns the rights. B esides, it also argued that the term 'arcelor' is known only in relation to it.

"It has no meaning in English or in any other language. A Google search of the word "arcelor" displays several results, all related to the complainant (ArcelorMittal)", the company had said.

The WIPO found that the respondent, the Mumbai-based entity, dealing in chemicals manufacturing, trading of cement, textile and pharamceuticals manufacturing, had no rights on the domain name. It held the registered sites were being used in bad faith.

James A Barker, who presided over the dispute, ordered the respondent to transfer the disputed domains to ArcelorMittal.

The WIPO is United Nation's specialised agency for developing a balanced and accessible international system in the field of intellectual property rights.

ArcelorMittal was formed out of a merger in 2006 between Arcelor and Mittal.It operates a website www.arcelormittal.com and in 2009, the company had revenues of USD 65.1 billion and crude steel production of 73.2 million tonne, representing approximately 8 per cent of the world steel output.

Cybersquatting is the practice of illegally buying and registering an address that is the name of an existing company or a well-known brand or person, on the Internet.
