CJI concerned over ‘misuse’ of RTI Act

Subhash Chandra Agrawal | April 16, 2012

This refers to the concern of chief justice of India on ‘misuse’ of RTI Act by individuals seeking unnecessary information about the judicial system. But it would have been better if he would have also suggested steps to make disclosure of certain aspects relating to administrative part of judicial system, as directed by the Central Information Commission, to check the number of RTI petitions burdening not only the Supreme Court but also the CIC. Rather it has become a trend to challenge CIC verdicts in courts with the latest one on information on medical-bills of individual judges.

More importantly, the CJI should take immediate steps to constitute a constitution bench to decide long-pending three petitions filed by the Supreme Court registry against CIC verdicts at the Supreme Court. Speedy disposal of the three petitions will automatically decide many issues concerning RTI and judicial system. Unfortunately, the constitution of the bench is being deferred as a division bench of apex court directed on November 26, 2010 its registry to put up the matter before the CJI for constituting a bench to decide the issues involved.
